In Tennessee, a multiple DUI offense is any DUI that occurs within 10 years of a previous DUI conviction. This means that if you are convicted of DUI and then are arrested for DUI again within 10 years, you will face enhanced penalties.

It is important to note that the 10-year period is calculated from the dates of the arrests, not the dates of the convictions. This means that if you are arrested for DUI and then are arrested for DUI again within 10 years, you will face enhanced penalties, even if your first DUI case is still pending.

What Are the Penalties for Multiple DUI Convictions in Tennessee?

Multiple DUI convictions carry significantly harsher penalties than first-time DUI convictions. The specific penalties you will face depend on the number of prior DUI convictions you have and the circumstances of your case.

Penalties for multiple DUI convictions in Tennessee include:

  • Second DUI: 45 days to 11 months in jail, fines of $600 to $3,500, 2-year driver’s license suspension, and mandatory ignition interlock device (IID) installation
  • Third DUI: 120 days to 11 months in jail, fines of $1,100 to $10,000, 6-year driver’s license suspension, and mandatory IID installation
  • Fourth DUI: 150 days to 6 years in jail, fines of $3,000 to $15,000, 8-year driver’s license suspension, and mandatory IID installation
  • Fifth DUI: 1 year to 6 years in jail, fines of $3,000 to $15,000, 8-year driver’s license suspension, and mandatory IID installation

In addition to these penalties, you will also be required to attend an alcohol and drug treatment program and will be required to pay for the cost of the program. You will also be required to pay for the cost of the IID installation and maintenance.
